Abstract

One of the debt practices carried out by the community in Karang Tengah Village, Kandangan District, Kediri Regency is debt or borrowing money by providing collateral in the form of rice fields, this is better known as sende. The people here carry out debt transactions with the marhun of the fields as collateral, the entire yield of the fields belongs to murtahin as long as the fields that are mortgaged are in his possession. The practice of paying off the use of collateral in this transaction has an irregularity that leads to the occurrence of loans that attract benefits, namely the debtor requires that the collateral be used and the proceeds belong entirely to murtahin. The implementation of the practice of sending rice fields by the people of Karang Tengah Village, Kandangan Subdistrict, started with rahin (pledge giver) seeking information from neighbors and relatives about murtahin (pledge recipient) who was willing to lend some money by guaranteeing rahin's rice fields. This field research uses a qualitative descriptive approach using the Sociology of Islamic Law approach. The nature of this research is descriptive. Data collection methods used are observation, interviews, and documentation. Then analyze qualitatively where the data obtained from the field is analyzed by deductive method which is then checked for validity. In the practice of religion and the application of the DSN-MUI Fatwa Number: 25/DSN-MUI/III/2002 to the community, the practice of sending rice fields is still not perfect because in practice the community emphasizes the economic side. This is because the people in sending sende prioritize economic factors rather than rules that are in accordance with sharia, this can be seen in the implementation of sende which emphasizes willingness without any pressure and elements of coercion, a high level of trust in each party.
